Welcome to the Privacy and Data Protection Policy ("Privacy Policy") for The Ops Engine™ and The Ops Network.
Both brands are operated by THEOPROJECT LTD ("we", "us", "our"), a company registered in England and Wales, with its registered office at 124 City Road, London, EC1V 2NX. THEOPROJECT LTD is the data controller responsible for your personal data.
We are committed to protecting and respecting your privacy in accordance with the UK General Data Protection Regulation ("UK GDPR"), the Data Protection Act 2018, and all other applicable data protection laws.
This Privacy Policy explains how we collect, use, and protect your personal data across our websites and services, and outlines the rights you have in relation to that data. It covers two audiences:
Clients and prospective clients who engage, or enquire about, The Ops Engine™ for operational support.
Operators who apply to, or are part of, The Ops Network — our vetted collective of senior freelance operators deployed on client engagements.

The data we collect
We may collect, use, store, and transfer different kinds of personal data about you, grouped as follows:
Identity Data: name, title, company name, job title.
Contact Data: email address, telephone number, business address.
Talent Profile Data (for The Ops Network operators): professional experience, areas of specialism, sectors worked in, seniority, availability, day rate, LinkedIn profile, CV, references, and any other information you provide as part of your operator profile.
Engagement Data: information you share with us in the course of an enquiry, proposal, or engagement.
Technical Data: IP address, browser type and version, time zone setting, operating system, and platform, collected when you use our websites.
Usage Data: information about how you use our websites and services.
Marketing and Communications Data: your preferences in receiving marketing from us and your communication preferences.
We do not knowingly collect any special categories of personal data (such as health, race, religious beliefs, or political opinions), and we ask that you do not share such data with us unless strictly necessary for an engagement.
How we use your personal data
We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
Responding to client enquiries and providing proposals — using Identity, Contact, and Engagement data, on the basis of our legitimate interests or to take steps to enter into a contract.
Reviewing applications to The Ops Network — using Identity, Contact, and Talent Profile data, on the basis of your consent or to take steps to enter into a contract.
Matching operators with client engagements — using Identity, Contact, Talent Profile, and Engagement data, on the basis of our legitimate interests or the performance of a contract.
Delivering our services — using Identity, Contact, and Engagement data, on the basis of the performance of a contract.
Invoicing, payment, and paying operators — using Identity, Contact, and Financial data, on the basis of the performance of a contract or to comply with a legal obligation.
Sending updates, newsletters, and relevant opportunities — using Identity, Contact, and Marketing data, on the basis of your consent or our legitimate interests.
Administering and improving our websites — using Technical and Usage data, on the basis of our legitimate interests.
Marketing communications
We may send you information about our services, network updates, or relevant opportunities where you have consented or where we have a legitimate interest to do so. You can ask us to stop sending marketing communications at any time by following the unsubscribe link in any message or by contacting us directly.
Disclosures and sharing of your personal data
We may share your personal data with the following categories of recipients:
Clients: Where you are an operator in The Ops Network, we may share your Talent Profile Data with prospective and current clients for the purpose of proposing and arranging engagements. We share only the information relevant to the opportunity.
Service providers: Third parties who provide IT, hosting, payment processing, accounting, and administrative services to us.
Professional advisers: Lawyers, accountants, and insurers where necessary.
Regulators and authorities: Where required by law.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes.
International transfers
Where we transfer your personal data outside the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one appropriate safeguard is in place — such as transferring to countries deemed to provide an adequate level of protection, or using contracts approved for use in the UK (the International Data Transfer Agreement or equivalent).
Data security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorised way. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

For operators in The Ops Network, we retain Talent Profile Data for as long as you remain an active member, and will remove or anonymise it on request or after a period of inactivity.

The right to object to processing of your personal data.
The right to request restriction of processing.

If you wish to exercise any of these rights, please contact us. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). We try to respond to all legitimate requests within one month.
